The rapid evolution of telecommunications services in India has aided the overall economic and social development of the country. It has enabled better connectivity among users, increasing use of information and communication technology (ICT) services and emergence of a variety of new business models. Parallelly, there has been a quantum leap in the quantity and value of data that is being generated through the use of modern communication services. Each step of a user's interaction with ICT services, whether through traditional telecom services, devices, applications or other forms of content, results in the generation of large amounts of data.

Availability of data has enhanced the business and efficiency potential of data analytics. However, it is equally important to assess whether the data rights of individuals are being adequately protected in this changing environment. Data protection may therefore mean the ability of individuals to understand and control the manner in which information pertaining to them can be accessed and used by others. The Authority is of the view that the users should be empowered in respect of ownership and control of his/her personal data and to ensure this, all the players in the eco-system are bound to follow certain safeguards while collecting, storing and using the data pertaining to their subscribers. The consultation paper has been issued with the following objectives:
(a) To identify the scope and definition of Personal data, Ownership and Control of data of users of telecom services.
(b) Understand and Identify the Rights and Responsibilities of Data Controllers.
(c) To assess the adequacy and efficiency of data protection measures currently in place in the telecom sector.
(d) Identify the key issues pertaining to data protection in relation to the delivery of digital services. This includes the provision of telecom and Internet services by telecom and Internet service providers (TSPs) as well the other devices, networks and applications that connect with users through the services offered by TSPs and collect and control user data in that process.

Last date for submission of suggestions is 7th November, 2017, midnight.

Sir, DND mechanism needs to to be strengthened as now even if number is DND still SMS and calls come, apart there needs to be a data security and enforcement laws for data as nowdays data from bank balances to stock market is selling freely on open market and these companies deal in stolen data with impunity due to lack of laws to prosecute them. There is a difference between security of data and privacy I am talking of both in capital markets as there is huge data leak from banks and exchanges

Personal data includes name, date of birth, address, mobile number, email ID. These databases shouldn't be used by telecom or internet companies to generate profit without the consent of the user. Actually it should be used to enhance the customer satisfaction in terms of service quality. Instead of upgrading the 3G networks the telecom companies provides mobile number to 3rd parties who disturb the customers by calling now & then even after DND activation.

The greatest grey area is data speed and qty promised to be provide by service provider with actual speed provided and billed. There is no way to check at user end the actual speed and data used by him. Service providers getting away fooling the users. Do something in this area where user must know what he is getting, and matching with what he has been charged for.

Maintain a ombudsperson 1. to handle Data Protection Queries 2. perform random and regular external audits of Telecom Operators Data Handling Capabilities and publish the results online. 3. Even Judiciary and government should access personal Data only with consent of person.(This right can be removed if person is found guilty by Judiciary and even then also only in presence of Judicial authorities,and the concerned person Data has to be retrieved. )

You have taken right step for mobile connectivity services sim cards with aadhaar compulsory. That was nice, make sure of protection of data of personal consumer with telcom operator. I would like to suggest make one nation one network, avoid roaming while moving across other states. Though GST came in to force, i don't know still roaming is there. Network operators are getting money with roaming. Have a look in to it. #TRAI

All social media apps must observe following.. 1-Fair usage policy link right on main page of app or site along with link to it at the user interaction sections. 2-Account the channel holder for monitoring of fair usage violation on their channels

For all telecom manufacturing companies must demonstrate following. - All pre installed software or embeded firmware must be free of any mallacious code. - Configuration manual must include exclusive section for reccomened config for optimal and efficient network security in an objective manner.
