The Finance Minister in his budget speech for the Union Budget 2015-16 interalia stressed the need to streamline the institutional arrangements for resolution of disputes relating to public contracts and proposed to introduce Public Contracts (Resolution of Disputes) Bill. The relevant excerpt from his budget speech is as follows:

"73. On the other hand, disputes arising in public contracts take long to resolve, and the process is very costly too. My Government proposes to introduce Public Contracts (Resolution of Disputes) Bill, to streamline the institutional arrangements for resolution of such disputes."

2. Accordingly, a preliminary first draft of Public Contracts (Resolution of Disputes) Bill, 2015 has been prepared. The proposed legislation is envisaged to deal with the contracts entered into by Public Authority for construction projects and infrastructure projects including PPP projects.

3. The draft bill is attached for obtaining comments/views of stakeholders.

Every work should be checked by outside officers before payment of bill as implemented in BRGF schemes in W.B. Defect liability period of road works should be raised to 5 years as implemented successfully in W.B.Contract should not only be awarded on the basis of lowest quoted rate but also previous record of completion of work in time and quality of previous works should be given taken in account.

PRANAM OUR SYSTEM SHOULD BE CORRECTED FROM THE ROOTS.I URGE TO FIND A BETTER SOLUTION TO THE BEST OF THREE QUOTATION.FOR GETTING THE WORK ORDER THREE QUOTES OF DIFFERENT NAMES IS GIVEN BY THE SAME VENDORONE WHICH HAS TO BE BILLED IS O.K.REST ALL FAKE. THIS PRACTICE IS COMMON FOR AS THE SANCTIONS AREMIN HOUSE AND NO TENDERS ARE TO BE CALLLED FOR e.g ITEMS OF VALUE BELOW 25000.

The contracts for construction projects and infrastructure projects tenders should be opened by the government through outside officers not from the local officers because local offices have fixed some commissions on each & every projects which they will get during issue of final payments. As well as the project should not be verified by local engineers/ officers (J.E.) after completion of projects. As per my knowledge contractors never spends 100% on any projects as per tender or project cost.

Every work shoud be dond by one higher level committe where as all member trustable with u and the committe are responsible.and one website for that where all the task must be classified statevise.so public can knnow it.for ex.every grant that are contribute mustbe classified for which purpose it and also by area at top to bottom level.and at server any person directly complain if it dont utilized very vell.public needs output.at server level top authority that can suspend who dont work.

Honble PM sir , Before initiating a draft please let the committee bear in minds that this draft is going to serve the citizens of a country where cheats are standing on the way from top to bottom. Top lavel can be prevented by a vigilant leader like you.But perventive measured for bottom and medoim lavel are inevitable so as the law can serve efficiently both the poors and upper lavel citizens

Before releasing any contracts,put policy framework for delivery.Use technology. Using geotagging we know size and complexity of each constituency.We already know the geograhic constraints like water table, weather and other constraints. Feeding data from local municipalities we also know the common issues/trends.We also know the kind of resident welfare associations, Government institutes operating there like BBMP in Bangalore and constituent RWA. Using these, fix implementation/accountability

#Finance....I would like to favor to give contracts to Co-operative companies rather than to the private or PPP sectors.

#PublicContracts... For PPP sectors working is a very sensible matter. In many case we see the PROFIT goes to the PRIVATE Counterpart AND RESPONSIBILITY falls on The PUBLIC counterpart. So, to put an end to such practices you need to set up a highly powerful vigilance committee with a independent intercepting capabilities...
