The Ministry of Civil Aviation has issued draft rules to ensure ease of using drones in India on the basis of trust, self-certification, and non-intrusive monitoring. The Drone Rules, 2021, once notified, will supersede the UAS Rules, 2021, which came into force on March 12 this year.

The Rules aim to make the process of owning, possessing, exporting, importing, manufacturing, trading, leasing, operating, transferring, or maintaining a drone in India, simpler and hassle-free. For that, the draft rules seek to abolish the requirement of various approvals, ranging from certificate of conformance, certificate of maintenance, import clearance, to student remote pilot licences.

Besides, it proposes the development of drone corridors for cargo deliveries and a drone promotion council to be set up to facilitate a drone-friendly regulatory regime in the country.

How the government shall keep the track about the rightful use of the drones? How the flight records shall be verified and who will verify the flight records? These key points have no mention in the proposed rules

Grievance addressal system is not specified in this rule. Third party insurance is as per motor vehicle act for drone related accidents. But there is no mention about reporting and complaints system about operations of drones. How a common person aggrieved by a particular drone operation identify the drone and it's owner and lodge the complaint?

The person seeking the licence shall specify the purpose for which he is seeking the licence. This purpose shall decide about the range of remote operations. For example if permission is sought for videography of marriages then a radius of operations of about 100 meters shall be permitted. If the purpose is for some commercial door delivery system then there shall not be any provision of video recording system in drones as the drone will pass over houses and their privacy may be compromised.
